Medical Malpractices
Medical malpractice is an offshoot of the broad basis of law. Broadly stated, medical malpractice is a term used to indicate treatments or lack of treatments, or other deviation from the standard, accepted norms of medical care, health care, or safety on the part of one or more health care providers which results in harm to a patient. These lawsuits target medical professionals. Those medical professionals include, but are not limited to, doctors, nurses, dentists, hospitals, pharmacists, chiropractors, any many, many more.
Lawsuits against medical professionals typically allege that there was negligence on the part of the medical professional in their rendition of medical services. Basically, a medical professional has an obligation to offer quality service.
There are numerous examples of medical malpractice. A few examples might be removal of the wrong limb, extraction of the wrong tooth, etc. Medical malpractice may also include such items as the misdiagnosis, improper treatment, failure to perform and/or delay in treatment, failure to perform appropriate follow-ups, errors regarding prescriptions, etc. Oftentimes, the general public may not even be aware that they may have been a victim of some sort of medical malpractice.
How is someone known if you have been the victim? Usually a determination would be made through analysis and research by a team of highly qualified experts in the specific field of medicine that was in question.
What information must be proven in order for the patient to be victorious in a medical malpractice case? Needless to say, there are countless different cases, and each, in its own way will be unique. However, in order to win a medical malpractice case, the claimant must usually show that one or more health care providers were to perform some sort of “duty” to the patient; that the health care provider(s) failed in some sense to perform said “duty”; that the patient in question suffered some sort of injury; and that said injury was caused by the health care providers’ breach.
Unfortunately, mistakes do occur due to the negligence on the part of healthcare professionals. If you or a loved one has been the victim of some sort of medical mistake, you need not suffer in silence. There have been settlements that have been quite substantial. One such case awarded the parents of a five-year-old child $250,000 as a result of improper care that their child was given when the child was born. In this particular case, it was determined that the negligence on the medical professionals’ part resulted in the girl’s loss of sensory powers, and her inability to sit up and feed herself.
Now that you know what medical malpractice is, how do you proceed? If you are, or someone that you know are, or believe that you have been a victim of medical malpractice, you need to find a medical malpractice lawyer. These specialized attorneys will fight for your legal rights.
